Next Gen Med Plus – Terms of Service

Welcome to Next Gen Med Plus. These Terms of Service (“Terms”) govern your access to and use of the services, memberships, and products provided by Next Gen Med Plus (“we,” “our,” or “us”). By purchasing or using any of our services, you agree to these legally binding Terms, which are in accordance with Florida state and federal law.

  1. Membership Terms
  • All memberships are annual and run on a calendar year basis, beginning January 1 and ending December 31 of the same year, regardless of when you enroll or activate the membership.
  • Memberships do not automatically renew. Clients will be responsible for re-enrollment each year.
  • Membership benefits and services do not roll over to the following year if unused.
  • Only the specific membership plan selected and any optional add-ons purchased will be honored. No substitutions or cross-plan benefits will be provided.

  1. Scope of Services
  • Next Gen Med Plus offers a variety of telehealth, medication management, preventative care, in-home services, and clearance services as outlined in each membership plan.
  • Services will be provided only as explicitly listed under the membership plan purchased and any documented add-ons selected by the member.
  • Memberships do not include emergency medical services or hospital coverage. Our services are strictly outpatient in nature and are intended for general, non-urgent healthcare support.
  • All services are delivered via licensed providers in accordance with applicable medical practice standards in the state of Florida.

  1. Nonrefundable Policy
  • All purchases of memberships and add-ons are nonrefundable, in compliance with Florida law, as they pertain to:
  • Medical services rendered or reserved;
  • Medical devices, prescriptions, and diagnostic procedures;
  • Administrative and technology support infrastructure put in place upon membership enrollment.
  • By agreeing to these Terms, you waive your right to claim refunds, chargebacks, or credits for unused, canceled, or declined services within your plan year.

  1. Client Responsibility
  • Members are responsible for:
  • Attending scheduled appointments and initiating contact to utilize services;
  • Ensuring their technology and internet access are functional to engage in telehealth visits;
  • Updating any personal, billing, or medical information as needed;
  • Complying with all platform policies, laws, and provider recommendations.

Failure to adhere to these responsibilities may result in delayed or denied services without compensation.

  1. Privacy and Data Protection
  • We maintain strict compliance with HIPAA and the Florida Information Protection Act (FIPA) for all personal and health-related data.

  1. Limitation of Liability
  • Next Gen Med Plus shall not be held liable for:
  • Any adverse outcomes related to services not rendered due to member inaction or misuse;
  • Any unauthorized use or access to your online portal;
  • Delays or inability to perform services caused by circumstances beyond our control, including but not limited to natural disasters, internet outages, or government mandates.
  • Services are provided “as-is” and “as available” with no guarantee of cure, resolution, or diagnosis.

  1. Modification of Terms
  • Next Gen Med Plus reserves the right to modify, amend, or update these Terms at any time, and such changes shall become effective immediately upon posting.
  • It is the member’s responsibility to review the Terms periodically.

  1. Governing Law
  • These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
  • Any legal disputes must be resolved in the state or federal courts located in Florida, and by agreeing to these Terms, you submit to this jurisdiction.
